County Attorney Joe Grubbs will have to answer for this:
Included in a gold mail folder that was handed to me before tonight’s Republican Party Executive Committee lies an incident report [Case No. 06-16721*2] dated Oct. 3, 2006 — that would be during the election for Ellis County Court at Law No. 2 that pitted incumbent Judge Gene Calvert, R-Waxahachie, against Grubbs’ assistant, Cindy Hellstern, D-Ennis.
Complainant: Complainant alleges on Tuesday Oct. 3, 2006, a white man in a “maroon Dodge vehicle” was masturbating; he was “fully erected and he was not trying to hide the fact that he was exposing himself.” Note: These quotes are from the Ellis County Sheriff’s Office incident report that I was handed - and the information was not redacted, but everything is spoken in context [sic]
Complainant a truck driver who makes regional trips to Seagoville, Forney, Terrell and other places (meaning he’s not from around here), wrote down the license plate of this Dodge four-door vehicle that he saw on the south-bound Interstate Highway 45 Mile Marker 263. The license plate: J25*NJT
That LP was registered to a Don and Cindy Hellstern of 400 W. Baylor in Ennis. Hellstern ran as a Democrat in both 2002 and 2006. She currently works for Grubbs in the DA’s office as a prosecutor.
Officer who took the report: Kenneth Hatcher
Officer (investigator) assigned: Michael Tobey
Offense: Disorderly conduct
Follow-up report #1: Daryl Spence (investigator)
Report #1 states:
This writer [Spence] attempted to contact the [complainant]. This writer left a message for the [complainant] to call this writer back.”
Follow-up report #2: Clint Tims (investigator)
Report #2 states:
This writer (Clint Tims #112) spoke with the complainant in this offense, [Complainant] by public service, phone # 847/804-6766 in reference to the offense reported. Writer asked [Complainant] if he could identify the suspect and the suspect vehicle in this offense & McDaniels’ advised that hecould. [Complainant] told this writer that the suspect was a w/m, mid 40’s or early 50’s, 220-240 pds., balding & was well dressed & he (suspect) was driving a ‘wine’ colored Dodge [four-door] Intrepid with TX LP# J25*NJT. Writer advised [Complainant]‘ that this offense was Class C misdemeanor, like receiving a speeding ticket & asked if he would be willing to testify in a court of law on the offense reported. [Complainant]‘ told writer that he was an over-the-road truck driver & that he usually made a run once a month to Seagoville, Forney, Terrell & Houston, TX, but if he needed to come down anytime sooner, he could. Writer told [Complainant] that this office would be back in contact with him upon further investigation into this offense. [Complainant] advised that he appreciated the call & would look forward to hearing from writer.
Of course, this never went to a court of law. In fact, according to investigators and defense lawyers who know about this case, this highly-sensitive report was quashed.
That, by the very definition, is a cover-up.
In 2006, according to the ECSO, Joe Grubbs’ office quashed and covered up an investigation into one of his top assistant’s husband for masturbating in his vehicle on Mile Marker 263 in Palmer on the night of Oct. 3.
This was at the height of the 2006 mid-term elections. Hellstern would go on to lose badly - again - to Calvert. But, had this issue gone out in the public beforehand, who knows the ramifications. Hellstern would have lost anyway, but still, it sat dormant until tonight.
The Ellis County Press will contact Joe Grubbs and Cindy Hellstern both about this. For now, mark up another blockbuster that The Ellis County Observer has broke.

I think it is amazing how you could recieve this info at 8:00 pm double verify all of the info contained and have it on your blog this quick.Now with you having two jobs you probably wanted to scoop yourself.Joey if any of the info contained is not correct then what is your plan,how will you defend yourself this time.Many a misdemeanor fails to get to court because an officer did not witness the incident.So as you stated in your piece that Joe Grubbs quashed this incident now is that in the report or is that conjecture on your part or do you factually know the outcome of this case.I have never heard of a responsible reporter exposing the coplaintants personal information so that the world see.
I surley hope that the next installment to this story will be Rodney Pat Ramsey’s arrest report with nothing missing including the subsiquent investigative facts.Why dont you ask for a copy of that case thru records request and read the outcome of that case.

Well, one, I had sources within the sheriff’s office telling me that the case was forwarded to the DA’s office and nothing happened.
Unfortunately, not a single one of them could identify themselves. And last night after my “pick up” of the contents of this folder, I did not know who the guy was. Never seen him in my life actually.
However, this is all a very meticulous attempt to swipe the real issue of the story.
Shepard, that entire case you’re referring to — the charges — was dismissed - every single one of them. Sure, Rodney plead to probation, but guess what, he’s now running for DA so that people like him aren’t wrung up like he was.
This isn’t even about Ramsey’s campaign either. I told Rodney last night that some guy gave me a folder with some report about Cindy Hellstern’s husband in it. He flat-out asked me, “where did you get *that* from?” I don’t even know the guy who gave it.
So, as you guys dick around with trying to intimidate me into removing this item or start negotiations for civil court, I’ll be breaking this story on the front page next week - or at least my freelancers will.
And all of you can go to hell in the meantime. Because you might have fooled others into cowing out and shriveling up, but you won’t be intimidating me or threatening me with court.
Don’t you guys realize this now? You’re dealing with a blogger who has more balls than probably half the business/political population in this county. I will expose all of you if it comes to that.

This is strictly from the incident report and from sources within the sheriff’s office.
I don’t know the process of submitting cases to the DA. However, I know what I was told (and what was alleged), and I have made that pretty clear with the original post.
I have nothing against Hellstern, but it just shows you the deliberate double standard that the DA’s office will take in regards to sex crimes.

Let me try to narrow the focus.
first, secret agent Joe, or Maxwell Smart as I shall refer to you from this point forward, it is not a crime to possess a nonredacted police report or have one in ones “possision” (whatever possision is) as you stated…
Secondly, it seems that we are missing the point here. You should be asking yourself…if this is a true allegation and it was covered up is that acceptable to you. Do you want to defend an office that would hide, destroy, or cover up a crime?
Thirdly, this not a class c misdemeanor, it was reportedly filed as indecent exposure which is a class “B” misdemeanor which most certainly goes to the office of district attorney.
And lastly, why would anyone want to defend such actions? How can you defend so many probations for sexual molestors and pedophiles?
How can you defend the actions that allowed that Doctor in Ennis to ejaculate semen on the face of a patient with Joe Grubbs and Patrick Wilson stating “Confirmation that the substance on Mrs. Simpson’s face was semen did not prove that a crime occurred, they said. And, they noted, it wasn’t until after Dr. Chitale was initially charged that other victims besides Mrs. Simpson reported allegations to police. Dalllas Morning News 09/29/2006.
How do you defend the probation of local attorney James Leonard, also accused of sexual assault of a child, who has since allegely fled the country and lis iving free to molest other children in other countries?
and on and on…the point to be made here has nothing to do with Joey Daubins or Rodney Ramsey or Cindy Helstern for that matter.
Obviously there are some who would support Joe Grubbs release of sexual preditors into their neighborhoods…who would agree that semen on their wives or daughters face after surgery doesn’t indicate a crime…how sad.
At least this blog will manage to open that closet in the
District Attorney’s office where the skeletons are hidden…let me just say a few months ago I stated that there is always more than one closet…and I was right.

Dear Malekum a.k.a. Rodney Pat Ramsey, the charge was not indecent exposure. If that file was removed by a county employee and not through a records request you are dead wrong. With the Info intact that JD claims to have it did not come from an open records request which by the way would have gone through the DA and therefore makes the idea of a coverup moot. Study harder!

Section 21.08 of the Texas Penal Code. Indecent Exposure. “A person commits an offense if he exposes his anus or any part of his genitals with intent to arouse or gratify the sexual desire of any person, and he is reckless about whether another is present who will be offended or alarmed by his act.
This is a Class B Misdemeanor. This offense carries a punishment range of up to 180 days in the county jail.
The one comment that said these types of cases never make it to the District Attorney’s office is clearly not informed. Class C misdemeanors go to municipal court or JP courts but Class B cases go to County Courts at Law because jail time is a possibility. There are plenty of Indecency Exposure cases filed across the State and prosecuted across the State.
Apparently, just not in Ellis County when you know the right people.
To defend this cover up in comments leads me to believe that you may be the person who hopes to be on the end of a favor like this from our current District Attorney, Joe Grubbs.
If your child had seen it on the highway, I guess you figure no harm no foul. Some of the stuff in response to what appears to be a serious issue is sad. It is sad because it is an obvious attempt to keep “change” from happening. CHANGE in the District Attorneys office has been needed for a long, long time. I can only hope that apathy does not prevent the change by low voter turn out. Mr. Grubbs has been in office for something like 20 years. Nothing even remotely similar to this should be happening on any District Attorney’s watch. It is time for new blood and real justice, not just to the ones who are not properly connected.

The people that want the status quo are the ones diverting the attention as to where or from whom this story came. The real issue is not where it came from or from whom, but that it is a REAL story. Now the Incumbent lovers will blame this on Rodney and dirty politics. Anybody here anywhere that Rodney had anything to do with uncovering this? Nobody ever want to give Joey credit for finding something newsworthy. Maybe you don’t like the guy, maybe he has taken you to task a couple of times, or maybe one of your friends. This is NOT about Ramsey or Joey or the love of Joe Grubbs. This is about official corruption from the highest law enforcement officer in Ellis County. I am sure Grubbs will be asked about this and we will see what he says. I am sure, ultimately, some tenacious reporter will either verify or prove false what has been reported. But the truth of the matter is, we have a problem in the DA’s office. And if this is true, and I assume we will all know soon enough. Then the problem is corruption, official oppression, favoritism, and justice is no longer blind. For those who love Saint Joe, then live with the consequences of those problems because unless you are his friend or employee, you may one day be sitting in the Defendant’s chair, falsley accused without the influence to get the favor he gives to those close to him.

But while I was teaching prospective lawyers in a university I was told not to worry about their spelling as they would have people writing for them they could pay little yet could still bill at lawyer rates.
All lawyers read the report above that say’s clearly, that after reading the report, the perp could be charged with a Class C offense (since he was gratifying himself and not an attempt to arouse others) so this case was never referred to the D.A..Sick yes but not the D.A.’s fault.Before you see Joey as a Super Hero realize he wouldn’t care if Podney Rat Pansey wasn’t running.

But I don’t think it was because you were having sex with another guy in a cemetary at night. I believe you that the two of you just enjoy the view there that time of night. I have walked that trail and it is indeed beautiful. Others just have a dirty mind or think because you use to, as you said, have some questions about your sexuality, that you like guys. How can you call yourself a Christian and spread lies and perpetuate rumors? The D.A.’s office via their prosecutors has not and will never compromise its ethics or morality to conceal or to fail to prosecute that which must be prosecuted. If you knew the law you would not say the stupid things you say. But you don’t. You barely know how to wipe your own butt much less figure out the complexities of prosecution.
Any member of law enforcement that has conspired with you or Rodney Ramsey to spread these lies about Mr. Helson should be presecuted and held accountable for their actions.

Someone forwarded this URL to me tonight and my morbid curiosity got the best of me…so I have read through the thread. Wow…this makes my stomach turn. I used to live in Ellis co…moved to the “perfect” little community in the 80’s. I soon was propelled into this darkness…the very one that I am reading now. I had a long term relationship with a law enforcement officer who knows all of these folks and still lives there…although he is no longer in law enforcement….he is still in the middle of this madness. The names of the players are still the same (with the exception of Joey who was a child when I was walking this ugliness). It is amazing to me that these people dedicate their lives in the fight of “good against evil”….and continue to do so. Take it from me, there is plenty of evil on both sides! I could telll stories that would, and could, turn the issues mentioned here into trivial matters of circumstance! But I will not….my only advice is to GET OUT OF THERE!! I have to say the time I spent in that community were the worst years of my life. There is a big, beautiful world out there and you guys are wasting precious minutes on this crap…instead of taking advantage of the beauty and wonder of what is outside of Ellis co! The best thing I ever did for myself is to leave that place and reposition myself as far away from there as humanly possible! It also saved my life…literally. What is going on there has been going on for years and will never change…..get over it, move one and enjoy your life.

Normally I don’t read the blog, but someone always lets me know when I am the topic of conversation as I was yesterday.
First let me say that this alleged incident, if true, is troubling for many reasons. I personally hope the reporting person might have been mistaken. Cindy has always been courteous towards me and I would not wish any of this on her. I am praying for her. There is however a need to determine if this incident was covered up. Obviously a police report was made by a complaining person alleging a crime. The question now is what happened once it was reported.
Unlike A Shephard, who is willing to defend any alleged misconduct within the office of County Attorney because of his unhealthy fixation of hatred towards me, most citizenss would be troubled if there had been such a cover up. Most citizens would believe it worthy of an investigation.
But keep in mind, here in Ellis County we have a good ol’d boy system, a vile and vicious undercurrent of black-hearted men who would support and endeavor to conceal just this sort of information. Here we have a few who spend a great deal of time and effort in shifting the blame and moving the focus from those contained in the police report.
This is partly what is wrong with Ellis County. This story was not about me, Joey, Charles, or Cindy, it was about a police report taken from some poor truck driver who felt he was the victim of a crime. Someone who wanted to file a report and have it investigated as a criminal complaint.
From there are those who have responded as though this was someone elses fault. The reporter has been threatened with civil suits, and criminal action, demeaned by anonymous cowards who, like cockroaches, flee from the light.
Are there those among you so blinded by your personal prejudices that you no longer have the desire to know the truth? So willing to spend so much wasted time on whether it was a class C or class B misdemeaner that you forget to ask whether it was actually reported and then covered up? Isn’t this really about whether a report was filed and then quashed or covered up? That is what I thought the story was.
I submit those who lash out defiantly against the truth are enemies of the truth, Perhaps they are why we grant so many probations to sexual preditors in this county. Shephard mentions that perhaps Joey should publish the names of the other Chitale victims and ruin their lives also….I believe it was Dr. Chitale who took the first steps to victimizing these women, and our District Attorney’s office who completed the travesty.
I contacted the victim who was finally responsible for bringing this sick creep to justice and told her that I had no intention of using her name or incident for political gain without her permission. Her response was to use it if it would help expose the miscarriage of justice that was committed against her and her family.
I wonder if anyone can defend against the fact that this Doctors semen was on a womans face after surgery..and she was not the only victim. How can anyone assert no crime was committed? I think if it were their wives or daughters it would be a crime.
Twelve years ago I started a fight for the truth and my personal freedom. I continue that fight today. I was advised back then that if I didnt like the way things were done in the Ellis County Justice system I could just go to law school and do something about it. I guess they thought I wouildn’t or couldn’t. Either way they didn’t know me then and they don’t know me now.
It just so happened that I had not only the grades, but the ability to enter law school. I prayed hard about it and then turned the decision over to God. I was accepted, finiished with good grades and passed the bar on the first attempt with points to spare.
I could have gone anywhere to practice law, but I came home to help my neighbors and friends, and with God’s help we have been very successful in doing just that. My wife and I both work hard each day to do the best for our clients and so far we have been able to help several people. For that I give thanks to God.
I learned a long time ago that you cannot please everyone, and there will always be those who will constantly demean my character and reputation. I am only sorry that those people don’t konw me, or anthing about me personally, and never will. Those who do know me hold a different opinion. Either way is good with me. It is sometimes hard to forgive, but that is what we are supposed to do according to my faith.
I try each day to do good works. I help those I can, and pray for those I can’t, and I believe it might be a good idea of some of you would do the same.
Anyone who wants to speak to me knows where I am, but then again, it is always easier to speak about someone rather than to them.

Ironic isn’t it, if Mr. Grubb’s office had done a more thorough job of prosecuting Mr. Ramsey in the drug case, Mr. Ramsey wouldn’t be running against him now. Wouldn’t it be even more ironic if Mr. Grubbs office intentionally went easy on Mr. Ramsey because he was a policeman…. then Ramsey comes back to retaliate. I think it would make a good movie….a t.v. movie, but a movie just the same.

First of all, learn to spell. Secondly, learn the law. Whether we like it or not. There is no crime for which that doctor could be charged for the semen. If you have a problem with it, as we all do, we need to contact our legislators and request an amendment. To prosecute a crime for which there is no legal basis would be corrupt.

It is only “gossip” if there is no proof. Sounds to me like there is substantial proof that a report was filed with the DA and no prosecution was pursued. That is “news” unless what you are referring to as “news” is only that which makes the DA look like a saint. Problem is, he is no saint, there was improper and potentially illegal behavior and those that want to call it gossip are jumping on the bandwagon of Grubbs to cover up the “cover up”. You may like the guy, he may be a nice guy, but his position as the top law enforcement officer in this county brings with it ethical requirements and responsibility. Was the case discussed with the DA’s office to determine the appropriate charge, or did the investigating agency, in this case ECSO, make the decision to investigate it as a class c misdemeanor? If so, who made that decision at ECSO, the reporting officer, an investigator, or higher? Law Enforcement personnel are not attorneys, and do not always see eye-to-eye with regards to what the appropriate charge should be based upon information, credibility, evidence, etc.
