County Attorney Joe Grubbs responded to questions from Ellis County Press reporter Jennifer Salinas today: “I know where you’re going with this [and] I’m not going to get into it. That’s enough questions.”
Grubbs denied ever receiving the Hellstern incident report. His office “never” received any case and nothing was ever filed.

This sounds like a typical “talk around” answer that usually comes from Joe Grubbs. Although true, that he has never received an actual case filed, to say that he has not seen the report is an outright lie. Grubbs was hand delivered a copy of the report from Sheriff Ray Stewart after a meeting one day on the Doris Phillips case. It was arranged by Grubbs to wait until after the election then his office was to contact the Sheriff’s Office on how to proceed further as to what they would or would not take as far as a criminal case. That call is yet to be received by the Sheriff. They were probably hoping to skate by on the two year statute of limtation, but it backfired. Joe needs to go. Vote for Rodney

So can Grubbs decide in his mind there is not enoguh evidence and just throw away the case?

Thats correct. Grubbs and his prosecutors have the final say as to what criminal cases they will or will not accept based on the evidence or lack thereof. I’m sure that Grubbs does not review every single case that comes through his office. That is why he has a staff of prosecutors. However, since this one involves a member of one of his employees’ family, and the nature of the case, it should have been (and was) brought to his attention before proceeding further. It seems to me that the Sheriff did the right thing in apprising Grubbs of the case beforehand just out of professional courtesy.

I have 1st hand knowledge from the Sec. of State of Texas that Gene Knize, Joe Grubbs, Lindy Tober, M.A. Montgomery, Cindy Hellstern are guilty of willfully, knowingly, intentionally violating Texas Penal Code 37.11 Impersonating Public Servants.
