I received a letter from a local defense attorney regarding this post. I will post two versions of it here.

But I replied that I will not apologize, either in private or in public.

And I’ll make it clear here that I will not provide a retraction. I have removed the offensive content but I will not apologize and I will not issue a retraction.

    I have spent the last 18 hours trying to make sense of your obvious disdain for the Rust Family. Your post yesterday was not only factually incorrect, but also highly uncalled for. I could understand you mentioning a parents name if the individual in question was a minor, but that is not the case in the instance. I can make no sense of you mentioning the same of a sibling that has no criminal history.

    I have known the Rust family the majority of my life and I can assure you some poor decisions made by one of their sons is no reflection of how he was raised or parented. If I am not mistaken you have in the past and continue to pursue a career in real estate. I do not believe it to be coincidence that you chose to target a family in the real estate business.

    I truly feel sorry for people like yourself who attempt to bolster their progress in life/business by defaming others. If you are unable to achieve a goal or certain level of success on your own merit or the positive attributes you may possess it may not be worth obtaining.

    Very articulate #1fiveman. I’m starting to see this is beyond just a fun blog, the negativity is starting to reveal a deep seated personality problem someone has and a false sense of some sort of power. Don’t bother to respond, I won’t come back, I want no part of this type of malicious aberant behavior.

    It’s all about duping people, beit by printing these Enquirer like “stories” or scamming trademarks by domain squatting. Its all about conning people, and I must say, he’s got a few conned.

    This is the way I see it. Just because this is a blog, does NOT mean Joey that you have the RIGHT to slander, defame one persons character. If somebody doesnt like what you have to say, then you are correct, they can stay off of your blog. BUT that doesnt mean that they’re not going to hear about it. I think its pathetic that you dont 100% verify what you “hear”. Just because you took off the information, does not mean that someone didnt save it, and it will soon come back to bite you in the butt. Karma is a bitch Joey, and it will come back to you TEN FOLD, and I hope your prepared for it.

    I’ve been trying to tell Joey that he will be dragged into court someday for his libelous statements. But he pulled a “Are you threatening me!?!?!?” Beavis type response, as if I was trying to threaten him, boy can’t even accept a helpful warning. It’s like he is drowning and I throw his a life jacket then he snarls at me and says “Are you trying to imply that I’m too stupid to swim?!?!. I’ve tried to tell him he will be sued and have to answer for every single word he types. For someone who proclaims that he as a better understanding of the law better than most judges, he sure doesn’t know how things work in our world.

    Depends on the meaning of “slander” and “defame.”

    Defamation is a pretty broad term. I could, in the strictest sense of that word, be “defaming” someone by simply posting the Rust arrest records - on all of them, sons and dad included.

    If you guys have a sole purpose and intent to threaten me, then it’s not working.

    I would defend myself and what I said any day. That’s just how I am.

    And if I’m in the wrong, I’ll admit to it like a man.

    But in this case, I don’t believe re-iterating what is already common knowledge was/is wrong.

    Any criminal history in your immediate family Joey? Either one of your parents been convicted of a felony?

    YOU even admitted you posted some offensive stuff, and you were quick to remove it. Therefore, if you found it offensive, then should simply be a man and say “I posted some offensive things, and I apologize, and I have since removed it”
